Introduction
Welcome to Cosmotorg - a Marketplace for Investment, Change of Ownership, Strategic Alliance and New Business.
Cosmotorg is facilitating the interaction between participants in the marketplace. Services available from our websites include, among other things,
making and reading announcements and advertisements, and communicating with other users.
These are the Terms and Conditions for using Cosmotorg websites and services. The present version of Terms and Conditions is effective of 15 August 2006.
The Terms and Conditions can be changed by us at any time. Changes will be introduced on our website, and will be effective from 30 days after the time of introduction.
Titles in this document are used for references and do not define or in any way limit the scope of the content under the titles.
Agreement
By using Cosmotorg websites and services available from domains
www.cosmotorg.net, cosmotorg.net, www.cosmotorg.no, cosmotorg.no,
sub-domains, and domains and sub-domains of our subsidiaries, franchises, agents and affiliates branded Cosmotorg, you are agreeing to the Terms and Conditions presented here.
By agreeing to these Terms and Conditions you enter into an Agreement with us. This Agreement is not creating any joint venture or other sort of agency or partnership
or employer-employee or franchiser-franchisee relationship. This Agreement is only regulating the use of our websites and services.
Only companies, individuals, groups and organizations, who can enter into a legally binding contract, can enter into this Agreement with us, and can use our websites and services.
No Warranty
Although we do our best effort to provide websites and services of highest quality, we do not give a warranty of uninterrupted availability or functionality.
Our websites and services are provided "as they are", without any warranty.
Payment
Some of our services are free, while others are provided for payment. In cases when you are offered a product or service for payment, the information about price
and payment will be presented to you, and you will have an opportunity to review and explicitly accept the offer before you will be obliged to pay.
The prices may change from time to time, but such changes will not be valid for on-going orders and related transactions,
which will be completed according to the agreed prices, if not renegotiated.
Information
You will present only valid and correct information in your Cosmotorg account, announcements, advertisements, and communication with other users of our websites and services.
We can not guarantee the identity of the other users and participants in the marketplace. Users of our websites and services
should apply caution and common sense when handling information.
Prohibitions
You will not:
Provide false, incorrect or misleading information;
Transfer your Cosmotorg account or Username or Member ID to another party without our consent;
Publish or distribute spam or pyramid schemes;
Make unauthorised use of copyrights or trademarks;
Gain access to, or otherwise collect or utilize information, which is not rightfully available to you;
Conduct any kind of fraudulent activity;
Act in a harmful or disruptive way towards our websites, systems or services, or other users;
Cause any liability issue for us;
Violate this Agreement.
Suspension and Exclusion
We can, with no limitation of other measures, suspend or terminate your account and/or terminate your transactions with us and/or remove your items
and/or remove any or all of your information published on our websites, if we have a reasonable suspicion that you have violated this Agreement.
License
You grant us a perpetual, irrevocable, non-exclusive, royalty-free, and worldwide right to exercise the copyright, publicity,
and database rights you have in the content you make available for readers in Cosmotorg, for any information media.
This license is necessary for us for being able to show your publications to the readers.
Privacy Policy
The aim of collecting, registering and maintaining information about you or related to your transactions is to provide you with the services of high quality, and for your own satisfaction.
The information available to us according to this Privacy Policy is used for:
- Preparing and conducting transactions with you
- Providing services to you
- Communicating with you
- Performing statistic analysis.
We do not sell, rent or give away any personal information about you to any third party. Only we and our trusted associates
who need to know such information have access to it when it is necessary for your membership, transactions and communication with us.
We do not read, edit, copy, store or log messages sent to Cosmotorg members using message forms on our websites.
Our security system may automatically remove any program codes from such messages before they are directly sent to the members'
registered email addresses via standard email servers.
No Claims
You will not hold us (nor our subsidiaries, joint ventures, franchises, affiliates, representatives, consultants, agents, officers,
employees or owners of Cosmotorg) responsible for users' activities, actions or inactions.
You will indemnify and hold us harmless from any fee, claim or demand made by any third party caused by, or related to your violation of this Agreement or any law or rights of a third party.
We will not accept any claims related to such cases.
Disputes with Us
The parties to this Agreement (you and we) are committed to make their best effort for resolving any possible dispute between themselves with good will.
If a dispute, however, is not resolved to both parties' satisfaction, the case shall be escalated to competent arbitrator or court in Norway, to be treated under Norwegian law.
Limit of Liability
You shall in no event hold us liable for any losses or damages that may in any way be related to our websites or services.
However, if we are found to be liable in any case, our total liability to you and to any third party will be limited to the lesser of
1) fees and charges you have paid to us during the 12 months prior to the event causing the liability, and 2) 1000 EUR.
Disclosure
When expressions like "you", "your" are used about a party related to this Agreement, these are referring to the users of our websites and services.
When expressions like "we", "us", "our" are used about a party related to this Agreement, these are referring to the organisation of Cosmotorg (see contact info).
